"Absent without leave" means the signed minutes of a meeting held while they were on council neither list them as present nor excuse them, and no similar name appears that day, so misspellings in the minutes don't count against anyone. Each square links to the minutes.

Thank you, Madam Speaker. I rise to speak on the third quarter performance report for MTC. Really, this one I'm going to speak about accountability, action and the path forward for MTC. On one hand we see an organisation capable of high level performance evidenced by 85% execution of the risk management implementation plan and full alignment with the King IV Code of Corporate Governance. On the other hand we see
severely dragged down by systemic and unacceptable legislative failures. Let's not sugarcoat the reality, we have fallen short of the very laws designed to protect public funds. So, from the report ma'am, I'm going to say that on page 128 this report highlights a direct breach of the Municipal Finance Management Act, MFMA, number 56 of 2003, specifically relating to the overspending of our approved operational budget.
Under the MFMA, the consequence of unauthorised spending overspending is not just an accounting adjustment, it is a severe statutory violation that exposes this entity to unauthorised expenditure reporting, potential funding withdrawals by the Treasury and strict disciplinary processes for financial misconduct. Furthermore, we
submit our reports late. Quarter two performance report was completely missed the timeline for our mid-year budget and performance assessment report. This also violates the Systems Act, 32 of 2000 of the MFMA and the MFMA. The consequence of failing to submit these reports is severe. It strips away public transparency, compromises Council oversight, and can result in the Auditor-General issuing a degraded audit outcome
for material non-compliance. Also on page 162 and 182 of the report we see ongoing failure to settle the supplier invoices. This directly breaches Section 65(2) of the MFMA. The consequences here are devastating to our economy, we choke the cash flow of small businesses, we invite litigation, incur avoidable interest expenses and completely destroy MTC's market reputation. Worse still,
the Auditor-General and internal audit flagged massive internal control failures, including an incomplete asset register, misstated financial statements, and a shocking failure to disclose awards made to close family members. These seriously need to be addressed. And then the age-old problem that we experience there, resolving the shareholder loan. This is our critical target, but perhaps the most glaring financial wound
in this entire report can be found on page 68. During this quarter alone, MTC incurred a staggering 59,639,000 in fruitless and wasteful expenditure. Why? Because of heavy interest charges bleeding out from the shareholders loan.
Let me be absolutely clear about what that means. Under the MFMA, allowing fruitless and wasteful expenditure to mount without aggressive intervention is a breach of our fiduciary duty. The consequence is clear, it diverts multi-millions of rands away from the operational delivery and infrastructure and directly impacts our liquidity, forcing us into a state of severe dependency on the parent city. I trust that we will address these issues as we go along. The DA will do all that it can to bring this department back to where it belongs. I thank you.
